1. Introductory provisions
These terms and conditions regulate the mutual rights and obligations in the sale of goods through the online shop of Akasana Europe s.r.o. The terms and conditions apply to purchase contracts between the seller (Akasana Europe s.r.o.) and a natural or legal person (the buyer) via the online shop. Different arrangements apply to contractual relations with entrepreneurs.
2. User account
The buyer can create a user account on the site. When registering, you must provide truthful information. Akasana Europe s.r.o. reserves the right to cancel the account if the buyer breaches his/her obligations or the account is not used for more than 2 years. Access to your account is protected by a password, which must be kept secure. The Seller is not responsible for misuse of the account by third parties.
3. Conclusion of the purchase contract
All presentation of goods on the website is informative and does not constitute an offer to conclude a contract. Orders are binding after confirmation by the seller via email. The Seller reserves the right to request additional order confirmation depending on the value or quantity of the goods.
4. Price of goods and payment terms
The purchase price is listed for each item, including VAT. The buyer can pay the price by bank transfer, online credit card or cash on delivery. The seller may request payment in advance. Together with the purchase price, the buyer is obliged to pay the costs associated with packaging and delivery.
5. Withdrawal from the Purchase Agreement
The buyer has the right to withdraw from the contract within 14 days of delivery of the goods without giving any reason. Withdrawal must be notified to the Seller in writing or by email. The goods must be returned in their original condition and packaging. The cost of the return is borne by the buyer. The Seller shall return the funds in the same manner as received.
6. Delivery of goods and acceptance
The goods are delivered by shipping service to the address specified in the order. The buyer is obliged to check the integrity of the packaging upon receipt of the shipment. In case of repeated delivery due to reasons on the buyer’s side, the buyer bears the additional costs.
7. Rights from defective performance (claims)
Complaints for defective goods must be made in writing or by email, stating the reason and description of the defect. The buyer may file a claim with the seller within 24 months of receipt of the goods. For entrepreneurs and legal entities, the warranty is provided for a period of 12 months from the date of receipt of the goods. The rights and obligations of the parties shall be governed by applicable law.
8. Privacy Policy
Personal data is processed in accordance with the GDPR. The buyer agrees to their processing for the purpose of contract performance and marketing purposes.
9. Other rights and obligations
Akasana Europe s.r.o. has the right to change the terms and conditions. The handling of complaints and out-of-court disputes is in accordance with applicable laws.
